These Terms of Use ("Terms") are between you and Experian Automotive, a division of Experian Information Solutions, Inc. ("Experian") and govern your use of Experian's virtual chatbot (the "Chatbot") as available to you from Experian's websites and mobile applications displaying the AutoCheck vehicle history report ("AutoCheck Report") that you are viewing. The automated Chatbot is powered by artificial intelligence, not by human beings, for the purpose of providing you with useful information about the AutoCheck Report you are viewing and reported events (the "Services"). The Chatbot uses computer modeling of conversational language to process and simulate human conversation in order to respond to questions about the Services. If you are a resident of or located in any country other than the United States, you should not use the Chatbot.

These Terms apply to all use of and access to the Chatbot. You acknowledge that your use of the Chatbot constitutes acceptance of these Terms. If you do not agree to these Terms, do not access, use, or otherwise interact with the Chatbot. You can end the chat at any time by closing your browser or app.

Your Conversation (as defined herein) with the Chatbot is recorded, shared, and used for the purposes described herein or as otherwise disclosed to you at the time of your interaction with the Chatbot. By submitting a question/prompt in the Chatbot, you consent to the collection, processing, disclosure, retention, and use of your question(s)/prompt(s) and the Chatbot's response(s) (the "Conversation") for the purposes described in these Terms, including, without limitation, to provide you with the Services, for detection of misuse of the Chatbot, fraud prevention, research, development, analytical purposes, to build new products, and to improve the Chatbot or other services.

Experian will retain and may associate your Conversation to your Experian account/profile, and you understand and agree that Experian may share the Conversation with its service providers. You agree to not enter personal information in the Chatbot, such as your name, address, or financial information. You agree that your use of the Chatbot and information you provide in Conversations will be subject to our Privacy Policy.

The Chatbot is designed to provide you with a summary of, and information in and relating to, the AutoCheck Report you are viewing, including, but not limited to, explaining reported events, definitions, and reporting policies. To provide you with the Services, the Chatbot uses information from Experian's vehicle history database, AutoCheck glossary and policies, and State department of motor vehicle, NHTSA, NTSB and industry association published vehicle event definition and policy information.

THE INFORMATION CONTAINED IN THE CONVERSATION DOES NOT CONSTITUTE LEGAL, TAX, ACCOUNTING, OR OTHER PROFESSIONAL ADVICE. NEITHER EXPERIAN, ITS AFFILIATES, OR ITS LICENSORS WARRANT OR MAKE ANY REPRESENTATIONS REGARDING THE OPERATION OF THE CHATBOT, THE USE, VALIDITY, ACCURACY, OR RELIABILITY OF THE RESPONSES PROVIDED IN THE CHATBOT, OR OF THE USE OF THE MATERIALS AVAILABLE OR ANY OTHER WEBSITE LINKED IN THE CHATBOT. THE MATERIALS MAY BE OUT OF DATE, AND NEITHER EXPERIAN, ITS AFFILIATES, NOR LICENSORS MAKES ANY COMMITMENT TO UPDATE THE MATERIALS ON WHICH THE CHATBOT RELIES. NEITHER EXPERIAN, ITS AFFILIATES, OR LICENSORS WARRANT THAT THE CHATBOT, SOFTWARE, MATERIALS, PRODUCTS, OR SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE OR THAT ANY DEFECTS IN SOFTWARE, MATERIALS, PRODUCTS, OR SERVICES WILL BE CORRECTED.

Your use of the Chatbot is restricted. Your use of the Chatbot is limited to your access to and use of the Services. You shall not: (i) modify or create derivative works based on the Chatbot; (ii) copy, frame, or mirror any part of the Chatbot or its content; (iii) share, sell, post, or otherwise provide the Conversation or responses provided in the Chatbot to any third party; or (iv) reverse engineer the Chatbot. Any use of this Chatbot other than as is expressly described and permitted in these Terms is prohibited. You agree that you will not submit unlawful, criminal, abusive, confidential, sensitive information, malicious code, intellectual property, or otherwise objectionable material, which violates the rights of you or other persons in the Chatbot. Experian may discontinue your ability to access the Chatbot at any time.
